Terms & Conditions

These Terms & Conditions govern your access to and use of ProgencyX, including our website, public listing pages, agent profiles, buyer and seller inquiry forms, dashboards, subscription features, billing flows, and related services. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use ProgencyX.

ProgencyX is a real estate visibility, listing, inquiry, and agent profile platform. The Service may allow users to browse public listings, discover agents, submit buyer or seller inquiries, create accounts, manage listings, view inquiry activity, and access paid agent dashboard features.

ProgencyX is not a real estate brokerage, mortgage lender, title company, legal advisor, tax advisor, escrow service, or financial advisor. We do not represent buyers or sellers in real estate transactions unless separately stated in a signed written agreement with the proper licensed party.

You must be legally able to enter into a binding contract to use the Service. If you use ProgencyX on behalf of a company, brokerage, team, or other organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Account information must be accurate, current, and complete. We may suspend or restrict access if we believe information is inaccurate, misleading, unauthorized, or used in violation of these Terms.

Agents, teams, and real estate professionals are responsible for ensuring that profile information, licenses, credentials, service areas, claims, listing details, property images, pricing, availability, brokerage affiliations, and advertising statements are accurate, lawful, and compliant with applicable real estate laws, MLS rules, fair housing rules, advertising rules, brokerage policies, and professional standards.

You must have all rights and permissions needed to publish listings, images, logos, profile content, property details, and related materials. You may not submit fake listings, misleading information, unauthorized photos, discriminatory content, bait pricing, deceptive claims, or content that infringes another party's rights.

When users submit an inquiry, ProgencyX may route that inquiry to an agent, team, support workflow, or dashboard. We may filter or verify inquiries to reduce spam, abuse, duplicates, automated submissions, or low-quality requests.

ProgencyX does not guarantee that any inquiry will result in a transaction, appointment, listing agreement, purchase agreement, commission, closing, or specific business outcome. Inquiry volume and quality may vary based on market conditions, listing activity, profile strength, user demand, geography, and other factors.

Paid agent features require an active paid plan. Plan details, pricing, duration, included features, and optional add-ons are presented at checkout, onboarding, or inside the Service. You authorize ProgencyX and our payment processor to charge your selected payment method for the plan, add-ons, taxes, and other amounts you select.

Payments are processed by Stripe or another payment provider. Your use of payment processing services may be subject to the processor's own terms and policies. We do not store full payment card numbers on our servers.

Prices, plan names, features, add-ons, and billing options may change from time to time. Changes will apply as disclosed at the time of purchase, renewal, upgrade, or as otherwise permitted by law.

You may cancel a subscription according to the cancellation tools or support process available in the Service. Unless a plan or written agreement states otherwise, cancellation stops future renewals but does not automatically refund amounts already paid.

Fees are non-refundable except where required by law or expressly stated in a specific plan, promotion, or written agreement. If access continues through a prepaid term, your account may remain active until that term expires unless we terminate access for a violation of these Terms.

Optional add-ons, promotions, visibility boosts, listing placements, paid advertising management, conversion support, or other growth systems may have additional terms, limits, budgets, setup requirements, or performance assumptions. Unless explicitly stated in writing, add-ons do not guarantee views, leads, closings, revenue, or specific placement for any fixed period.

You agree not to misuse the Service, violate laws, interfere with security, attempt unauthorized access, reverse engineer the Service, scrape or harvest data without permission, upload malware, send spam, impersonate others, submit false information, manipulate inquiry systems, bypass payment, or use ProgencyX in a way that harms users, agents, the platform, or third parties.

You may not use the Service for discriminatory housing practices, unlawful steering, deceptive advertising, harassment, fraud, unauthorized lead resale, or any activity that violates fair housing, privacy, consumer protection, real estate, communications, or advertising laws.

You retain ownership of content you submit to ProgencyX. By submitting content, you grant ProgencyX a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, publish, modify for formatting, distribute, analyze, and otherwise use the content as needed to operate, market, protect, and improve the Service.

You represent that you have the rights needed to grant this license and that your content does not violate law, these Terms, professional rules, platform policies, or third-party rights.

The Service, including software, design, layouts, branding, logos, text, product structure, dashboard interfaces, graphics, and underlying technology, is owned by ProgencyX or its licensors and is protected by intellectual property laws. You may not copy, modify, sell, lease, distribute, or create derivative works from the Service without written permission.

ProgencyX may integrate with third-party services such as payment processors, hosting providers, analytics tools, email services, SMS services, maps, advertising platforms, MLS or listing data providers, and other vendors. We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.

We may contact you by email, phone, SMS, or in-product message for account, support, billing, security, transactional, onboarding, and service-related purposes. Marketing communications are sent where permitted and can be opted out of using available unsubscribe methods. Consent to marketing is not required to purchase.

We work to keep ProgencyX available and useful, but we do not guarantee uninterrupted, error-free, or permanent access. We may modify, suspend, remove, replace, or discontinue features, pages, listings, plans, add-ons, or the Service as needed for operational, legal, security, product, or business reasons.

ProgencyX is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

Real estate information can change quickly. Listings, prices, availability, agent information, market data, and inquiry details may be incomplete, delayed, inaccurate, or subject to change. Users should independently verify important information before relying on it.

To the maximum extent permitted by law, ProgencyX will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, opportunities, transactions, commissions, or business, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless ProgencyX from claims, damages, liabilities, losses, costs, and expenses arising from your use of the Service, your content, your listings, your inquiries, your violation of these Terms, your violation of law, or your infringement of another party's rights.

We may suspend, restrict, or terminate access to the Service if we believe you violated these Terms, created risk, failed to pay amounts owed, submitted inaccurate or unlawful content, misused inquiry systems, created security concerns, or used the Service in a way that may harm users, agents, third parties, or ProgencyX.

These Terms are governed by the laws applicable to the location where ProgencyX operates, without regard to conflict of law rules, unless applicable consumer protection laws require otherwise. Any dispute will be handled in the appropriate courts or forums permitted by applicable law.

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date. If changes are material, we may provide additional notice through the Service, by email, or as otherwise required by law. Continued use of ProgencyX after changes become effective means you accept the updated Terms.
